Ask Lambda Legal: Antigay Attacks on our Courts

Dear Ask Lambda Legal,

Q: I live in Iowa, and in the days leading up to the election remember seeing a bus with the slogan “No Wiggins” campaigning against the Supreme Court Justice.  I hear opponents of equality talking about “activist judges,” what are we doing in response?

A: In 2009, the Iowa Supreme Court issued a unanimous decision in Lambda Legal’s lawsuit Varnum v. Brien, striking down Iowa’s marriage ban and extending the freedom to marry to same-sex couples. In response, antigay groups like the National Organization for Marriage and the American Family Association, decided to take their anger out on the courts. In 2010, these groups spent nearly $1 million on a series of attack ads and a misleading bus tour in order to punish the justices for ruling against their extreme agenda. In the end, this mean-spirited campaign succeeded in defeating three well-respected justices during a routine judicial retention election.

This year, opponents of the freedom to marry came together again in another well-funded attempt to unseat the fourth justice from the Varnum decision, David Wiggins. The effort was spearheaded by failed gubernatorial candidate Bob Vander Plaats and consisted of a “No Wiggins” bus tour, which featured guest appearances from the likes of Rick Santorum and the Governor of Louisiana, Bobby Jindal. The campaign urged voters to throw out “activist judges” for doing the very thing that judges are supposed to do – namely decide tough cases and uphold constitutional rights, even if those decisions may not be politically popular.

But this time the wheels came off their antigay bus! On Election Day, voters rejected the politicization of their courts by retaining Justice Wiggins. By rejecting this assault on justice and attempt to intimidate judges, the people of Iowa demonstrated to the nation that we will stand up and protect the system designed to preserve our cherished rights and liberties.

For the LGBT community, courts resolve cases on fundamental issues that affect us all—our family life, employment and housing protections, access to health care, parenting rights—all of which can have long-lasting effects. Pregúntale a Lambda Legal: Ataque antigay en contra de nuestros tribunales

Q: Vivo en Iowa, y en los días antes de la elección, recuerdo ver un autobús con el lema “No Wiggins” haciendo campaña contra el Juez de la Corte Suprema. ¿He escuchado a adversarios de la igualdad que hablan de “jueces activistas,” qué hacemos en respuesta?

R: En 2009, la Corte Suprema de Iowa publicó una decisión unánime en el caso de Lambda Legal, Varnum V. Brien, extendiendo el derececho a casarse a parejas del mismo sexo. En respuesta, grupos antigay como National Organization for Marriage y American Family Association decidieron concentrar su rabia  en contra de los tribunales. En 2010, estos grupos invirtieron casi $1 millón de dolares en una serie de anuncios negativos y una campaña engañosa por autobús para castigar los jueces por fallar en contra de la extrema agenda política de estos grupos. Al final, esta injusta campaña   consiguió derrotar a tres respetados jueces  durante una elección rutinaria de retención judicial.

Este año, los adversarios al derecho al matrimonio para parejas del mismo sexo, se reunieron de nuevo en otro esfuerzo bien-financiado para derrotar a David Wiggins,  el cuarto juez, relacionado con el fallo en el caso. Varnum. . El esfuerzo fue encabezado por el ex-candidato para gobernador Bob Vander Plaats y consisitio enuna campaña con el slogan”No Wiggins” en los autobuses.  Tal campaña incluyó políticos como Rick Santorum y el Gobernador de Luisiana, Bobby Jindal. La campaña instó a votantes a expulsar a los llamados “jueces activistas” por hacer su trabajo – decidir casos difíciles y ratificar los derechos constitucionales, aun cuando sus decisiones no son políticamente populares.

¡Pero esta vez el autobus antigay se quedo sin llantas! En el día de las elecciones, los votantes rechazaron la politización de sus tribunales al retener a el Juez Wiggins. Al rechazar este ataque a la propia justicia y el intento a   intimidar   jueces, los ciudadanos de Iowa demostraron que no se quedaran callados y protegeran el sistema diseñado para preservar  las garantias individuales.

Para la comunidad LGBT,los tribunales determinan casos en asuntos fundamentales que nos afectan a todos—nuestra entorno familiar, las protecciones de empleo y vivienda, el acceso a la atención médica, derechos de padres de familia—todos los cuales pueden tener efectos duraderos.
